Terms and conditions governing the use of From Creation platforms and services.

1. Acceptance of Terms

By accessing or using https://fromcreation.co or any platforms, APIs, or software services provided by From Creation ("Services"), you agree to be bound by these Terms of Service. If you do not agree, do not access or use our Services.

2. Provision of Services

From Creation provides AI-accelerated software solutions, cloud-native web applications, and communication tools including our SMS Engagement Platform, Small Business Contact Center, and client management dashboards. We reserve the right to modify or discontinue any aspect of our Services with appropriate notice.

3. User Accounts & Third-Party Authentication (Google Sign-In)

To access certain features of our applications, you may be required to register an account or authenticate using authorized third-party identity providers, such as Google OAuth 2.0 ("Google Sign-In"). When authenticating through Google Sign-In, you authorize From Creation to access basic profile information strictly in accordance with our Privacy Policy. You are responsible for safeguarding your credentials and for all activities that occur under your account.

4. SMS & Mobile Messaging Terms (A2P 10DLC)

When you subscribe to SMS alerts, notifications, or communication channels through From Creation:

  • Opt-In: You provide explicit consent to receive informational and transactional SMS messages at the mobile number provided.
  • Message Frequency: Message frequency varies based on channel activity, alerts, or customer inquiries.
  • Cancellation (Opt-Out): You can cancel the SMS service at any time. Simply text STOP to the short code or number. After sending "STOP", we will send an SMS to confirm you have been unsubscribed, and you will no longer receive SMS messages from that program.
  • Support: For help or assistance, reply HELP to any message, or contact our support team at support@fromcreation.co.
  • Carrier Fees: Message and data rates may apply for any messages sent to you from us and to us from you. Check with your wireless carrier for details.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.

5. Application Development Scope, Deliverables & CRUD Operations

From Creation provides transparent estimates and promotional pricing tiers for custom software engineering—including Static Websites, Web Applications, Mobile Applications, Desktop Applications, and Custom APIs. The following terms govern all baseline application development engagements:

  • Standard CRUD Scope per Page or Screen: Each application page or screen in a standard baseline project consists of up to one (1) CRUD (Create, Read, Update, Delete) operation or primary business entity workflow.
  • Complex Workflows & Multi-Entity Logic: Pages, screens, or features requiring multiple distinct CRUD operations, relational database operations, complex state machines, multi-step transaction pipelines, or custom third-party integrations fall outside baseline scope and are quoted separately as custom requirements.
  • Development Only Deliverables: Except for managed annual Static Website tiers (which include turnkey cloud hosting, continuous updates, and bug fixes), standard application pricing (Web, Mobile, Desktop, and API) covers custom software engineering and codebase delivery only. Cloud infrastructure hosting, third-party subscriptions, developer account fees (e.g., Apple Developer Program, Google Play Console), and external carrier charges are client responsibilities unless an ongoing managed retainer is executed.
  • Change Orders & Scope Adjustments: Any expansion in screens, endpoints, or data models beyond agreed milestones will be documented and invoiced through mutually approved change orders prior to implementation.

6. Acceptable Use Policy

You agree not to use our Services to:

  • Send unsolicited spam, deceptive messages, or violate telecommunication regulations (TCPA, CTIA, CAN-SPAM).
  • Distribute malicious code, probe system vulnerabilities, or disrupt AWS cloud infrastructure.
  • Transmit content that is unlawful, defamatory, harassing, or fraudulent.

7. Intellectual Property

All custom applications, proprietary code, brand marks, and software designs created by From Creation remain the intellectual property of From Creation or are licensed under agreed client co-creation contracts.
